Terms of Service
These terms are an agreement between you and [Company legal name] (“Index”, “we”, “us”) for your use of the Index app and website (the “Service”). Our Privacy Policy explains how we handle your information.
Accepting these terms
By using the Service you agree to these terms. If you don’t agree, don’t use the Service. You must be at least 13 years old, or the minimum age required in your country, to use Index.
Your account
You can use Index without an account. If you sign in, you’re responsible for activity on your account and for keeping access to your sign-in method secure. Tell us promptly if you believe your account has been used without permission.
Your content
You own the books, quotes, thoughts and other content you add (“Your Content”). You give us a limited license to store, process and display Your Content only to provide the Service to you, including backups and answers from Ask your marginalia. This license ends when you delete Your Content or your account, apart from backup copies removed in the normal course.
Quotes you save may come from copyrighted books. Index is for personal note-taking. You’re responsible for how you use and share excerpts outside the app.
AI features
Ask your marginalia uses AI to answer questions based on your notes. Answers can be incomplete or wrong, so check anything important against your notes or the book. The assistant may propose changes to your library, which happen only after you approve them. Free accounts include a limited number of questions; Plus removes that limit, subject to reasonable use to prevent abuse.
Plus subscriptions
- Plus is offered monthly or yearly at the price shown in the app before purchase.
- New subscribers may get a free trial. Unless you cancel at least 24 hours before the trial ends, your subscription starts and you’re charged.
- Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before renewal.
- Payment is charged to your Apple ID. Manage or cancel in iOS Settings › Apple ID › Subscriptions.
- Refunds are handled by Apple under its policies.
- If we change prices, we’ll give notice in advance and the new price applies from your next renewal.
Acceptable use
Don’t use the Service to:
- break the law or infringe anyone’s rights;
- try to access other users’ data or our systems without permission;
- reverse engineer, scrape or overload the Service, or get around usage limits;
- use AI features to generate harmful or illegal content.
Our rights
The Service, including its design, software and branding, belongs to Index and its licensors. We grant you a personal, non-transferable license to use the app on Apple devices you own or control, as permitted by Apple’s Usage Rules. Feedback you send may be used to improve the Service without obligation to you.
Ending use
You can stop using Index at any time and delete your account in Settings › Your data. Export a copy first if you want to keep your notes. We may suspend or end access if you seriously or repeatedly break these terms. Where reasonable, we’ll give notice and a chance to export your data. We may change or discontinue features; if we shut down the Service, we’ll give at least 30 days’ notice.
Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee the Service will be uninterrupted or error-free, or that data will never be lost. Keep exports of anything you can’t afford to lose.
Liability
To the extent permitted by law, Index won’t be liable for indirect, incidental, special, consequential or punitive damages, or loss of data or profits. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50.
Some jurisdictions don’t allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection law.
Governing law
These terms are governed by the laws of [Jurisdiction], without regard to conflict-of-law rules. Disputes will be handled in the courts of [Venue], unless the law where you live gives you the right to bring claims locally.
Apple
These terms are between you and Index, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support, and is a third-party beneficiary of these terms with the right to enforce them against you.
Changes to these terms
We may update these terms. For material changes we’ll notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated terms.
